— Terms and Conditions for Art Commissions —

Welcome to our website. By requesting an artwork commission, submitting a contact form, or hiring the Artist via email, you (the "Client") agree to be bound by the following Terms and Conditions. Please read them carefully before initiating a project.

1. Scope of Work and Process

  • Project Initiation: Every custom painting or artwork request begins with a consultation via our contact form or direct email.

  • Design Specifications: The dimensions, medium, reference materials, and subject matter will be mutually agreed upon in writing before any work begins.

  • Artistic Freedom: The Client acknowledges that the final artwork will bear the Artist's unique style, perspective, and interpretation. Variations from past portfolio samples are celebrated as part of the original creation process.

2. Payment Terms and Deposits

  • Non-Refundable Deposit: To secure a commission slot and cover initial material costs, a 50% upfront non-refundable deposit is required before work commences.

  • Final Payment: The remaining 50% balance must be paid in full upon the artwork's final completion and approval, prior to packaging and shipping.

  • Payment Methods: All invoices are sent securely and must be settled via the designated electronic payment methods outlined during the email consultation.

3. Revisions and Feedback

  • Progress Updates (WIPs): The Artist will provide digital work-in-progress (WIP) updates at key milestones (e.g., initial sketch or composition block-in).

  • Included Revisions: The Client is entitled to up to two (2) rounds of minor adjustments during the sketching phase.

  • Major Changes: Any fundamental alterations requested after painting has advanced (such as changing the pose, size, or core subject) will incur an additional fee and extend the delivery timeline.

4. Copyright and Intellectual Property

  • Artist Ownership: The Artist retains all copyright, reproduction rights, and intellectual property rights over the created artwork.

  • Personal Use Only: The Client is buying the physical artwork for personal display use only. The Client may not reproduce, resell, print for merchandise, or use the image for commercial purposes without an explicit commercial license agreement.

  • Self-Promotion: The Artist reserves the right to share images of the work-in-progress and final artwork on social media or in digital/physical portfolios for self-promotion, unless a privacy request (e.g., for a surprise gift) is agreed upon in advance.

5. Shipping, Delivery, and Damages

  • Shipping Fees: The Client is responsible for all shipping and handling costs, packaging materials, and any international import customs/duties.

  • Delivery Transit: All physical artworks are shipped with premium tracking and insurance.

  • Damages: While the Artist packages every artwork meticulously to prevent damage, the Artist is not held liable for delays or damages caused by third-party shipping carriers. If an item arrives damaged, please document the packaging and contact us within 48 hours to file an insurance claim.

6. Cancellations and Refunds

  • Cancellation by Client: If the Client cancels the project after work has started, the 50% deposit remains non-refundable to compensate for the Artist's time and materials.

  • Cancellation by Artist: If the Artist must cancel the commission due to unforeseen circumstances or inability to complete the work, a 100% full refund (including the deposit) will be returned to the Client.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or dispute arising from these terms will be settled exclusively in the state or federal courts of the Artist's jurisdiction.
